General Terms and Conditions (GTC) of MAYDUNA Berlin

1. Scope of Application
   These General Terms and Conditions (GTC) apply to all services provided by AF Professional GmbH / MAYDUNA Berlin, specifically piercing procedures and the sale of piercing jewelry and care products. By availing themselves of one or more services, the customer agrees to these GTC.
2. Prerequisites for the procedure
   (1) Piercing requires the legally valid written consent of the person to be pierced. The identity of the person to be pierced must be verified using a photo ID (passport, driver’s license, etc.).
   (2) For minors between the ages of 7 and 14, only ear piercing is offered. At least one legal guardian must be present for this procedure. Both the legal guardian and the person to be pierced must be able to provide proof of identity. If legal guardianship is not clearly evident from the identification documents (e.g., due to different surnames or addresses), additional proof—such as a custody order—is required.

The presence of a legal guardian is also mandatory for individuals between the ages of 14 and 16.

For individuals aged 16 to 18, a signed consent form from a legal guardian, accompanied by a copy of their ID, is sufficient. The person to be pierced must also be able to provide proof of identity. The written consent must include the following information:

• exactly which piercing may be performed
• full name and date of birth of the person to be pierced
• the full name and date of birth of the person with parental responsibility
• the signature of the person with parental responsibility
• as well as a clearly legible copy of your photo ID

(3) Before obtaining written consent, a comprehensive explanation is provided regarding the risks associated with the piercing, the required aftercare, and possible adverse reactions. Written confirmation that this explanation has been provided is obtained.
(4) The piercing procedure is performed only if there are no indications of health-related contraindications (specific to the piercing).
(5) The studio reserves the right to refuse treatment if there are health risks or if the client is under the influence of alcohol or drugs.

3. Documentation
   (1) Written consent, confirmation that the client has been informed, a brief description of the service provided, and the batch numbers of the sterilization processes shall be documented and retained for ten years. A copy of these documents may be provided to the client upon request.
4. Limitation of Liability
   (1) AF Professional GmbH/MAYDUNA accepts no liability for complications or consequential damage resulting from improper aftercare, failure to follow aftercare instructions, improper handling of the jewelry, or further injuries (e.g., caused by accidents, snagging, etc.).
   (2) Liability for allergic reactions to jewelry materials or aftercare products is excluded.
   (3) The studio is liable only for damage caused by gross negligence or willful misconduct and reported by the customer within 48 hours of the service.
5. Hygiene and Care
   (1) The studio operates according to the highest hygiene standards. All instruments used are sterilized or are disposable items.
   (2) After the piercing, the customer receives detailed aftercare instructions and is required to follow them.

6. Payment and Prices
   (1) Prices for piercings and products are displayed in the studio and include VAT. In the event that prices on online platforms or websites differ from those in the studio, the prices displayed in the studio apply. The displayed prices cover the piercing service itself; the service does NOT include the jewelry. Customers select a piece of jewelry on-site based on their anatomy, the placement of the piercing, and personal aesthetic preference. Prices for jewelry vary and are communicated to customers prior to purchase and the performance of the service.
   (2) Payment is to be made immediately after the treatment, either in cash or by card.
   (3) Services already rendered are excluded from exchange or refund. AF Professional GmbH/MAYDUNA reserves the right to grant exchanges and/or refunds in individual cases and as a gesture of goodwill.

6.1. Complaints and Exchanges

(1) Due to the nature of body jewelry and public health regulations, AF Professional GmbH/MAYDUNA cannot accept returns of body jewelry. Before leaving the studio, the customer must ensure that the correct gauge, diameter/length, and design of the jewelry have been selected. Subsequent complaints regarding jewelry—even if it was not inserted on-site—cannot be accepted. This policy also applies to orders for individual pieces of jewelry.

6.2 Warranty

(1) Almost all pieces of jewelry come with a lifetime warranty against potential manufacturing defects. If a customer suspects that a purchased item has a material defect (discoloration, a gemstone falling out, etc.), the jewelry must be presented at the studio for inspection. Processing this inspection may take up to 7 business days. Other types of damage—such as a broken thread or pin resulting from improper use and/or incorrect opening or closing—are not covered. AF Professional GmbH/MAYDUNA is not liable for the loss of jewelry. Customers are advised to include their piercing jewelry in a private insurance policy or to purchase specific jewelry insurance to protect against loss or theft. AF Professional GmbH accepts no liability for damage caused by the customer or by other piercers or studios during the insertion, removal, or attempted repair of the jewelry.

7. Scheduling and Cancellation
   (1) Appointments can be scheduled in person, by telephone, or online.
   (2) Cancellations made up to 24 hours before the appointment are free of charge. In the event of a late cancellation or a no-show, a cancellation fee of 50% of the agreed price may be charged.
8. Data Protection
   (1) Personal data is collected solely for the purpose of providing the service and is not disclosed to third parties.
   (2) The customer has the right to access, correct, or delete their data at any time.

(3) If the customer consents to the studio photographing a completed work, they grant the studio the unrestricted and royalty-free right to use, reproduce, and publish the photograph. If the customer does not wish to be personally identified—for example, via tagging or linking on social media platforms—they must inform the studio of this when the photographs are taken.

9. Grounds for Refusal and Exclusion
   (1) The studio reserves the right to refuse service to clients who arrive at least 20 minutes late for their appointment. A no-show fee may also be charged in such cases.
   
   

(2) The studio reserves the right to refuse service to customers for whom the desired piercing cannot be performed due to anatomical conditions, and/or where successful healing is unlikely or health complications could arise.

10. Final Provisions
    (1) German law applies.
    (2) The place of jurisdiction for disputes is Berlin.
    (3) Should individual provisions of these General Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
